On 10 June the employees of children rights protection Service Tatiana Crestenco and Tamara Tentiuc made Working visit to Criuleni District Court and Prosecutor Office in order to monitor minors audience process in accordance with provision in. 1101 of penal procedure Code.
During the meeting realized in Criuleni District Court discussions were held with the chairman of the court Eugen Sănduța and Lucia Negruță, Head of the Secretariat.
The space for minors hearing was repaired in 2013 with the financial resources allocated from the Strategy of Justice Sector Reform, in amount of 28765,34 lei.
Room for hearings is equipped with the necessary (sofa, chair, camera, microphone), but it is not used because in the meeting room was not installed a screen for transmitting video / audio image.
Because of space lack in Court building, room for hearings is situated on the first flour, entrance in hearings space is achieved through courtroom where will be installed screen device, an aspect that does not meet the spatial requirements regarding equipment of spaces designated for minors hearings in special conditions.
In 2014 in Criuleni District Court was received only one criminal case where the child had to be questioned under special conditions. The instruction judge conducted minor’s hearing in special conditions in hearing room of the International Centre "La Strada".
Other requests for the hearing of minors under special conditions were not received and were examined by the instruction judge
The Prosecutor of Criuleni District, Andrei Machedon explained that only in the examination of a single case, in criminal prosecution phase, the minor was heard under the terms of Article 1101 CPP.
The minor's hearing procedure took place in special equipped space, from the Orhei District Prosecutor’s Office. At the hearing being invited as interviewer, psychologist within Orhei pedagogical Assistance Service Orhei.
Small number of minor victims / witnesses hearing in the special conditions was explained by the Prosecutor due to the fact that the prosecuting authority avoid to rely on the testimony of minors being researched other evidence and resort to minors hearing in complex cases.
Prosecutors explanation is not justified one in a situation when as representatives of Court instance as well as prosecutor mentioned that offence index in Criuleni is growing, and domestic violence is among the most criminal cases examined by the criminal investigating authority.
