Plîngere referitor la condiţiile de detenţie, examinată în cadrul MNPT

To the Center for Human Rights of Moldova received a complain of aconvicted inmate V. T. that is detained in the Penitentiary Institution Nr. 13 in Chișinău municipality, regarding the fact that he is intentionally subjected to inhuman and degrading treatment by holding in inadequate conditions of detention, due to what he suffered mental anguish caused by an increased intensity.
Within the activity of the National Mechanism for the Torture Prevention on 28.05.2014, the employees of the Center for Human Rights of Moldova Mr.Gheorghe Bosîi and Mr. Iurie Dubenco carried out a preventive visit to the Penitentiary Nr. 13 from Chişinău, In order to monitor the conditions of detention in cell nr. 46 Block 2, mentioned by the petitioner.
Regarding the conditions of detention in the respective cell was found the following: natural light penetrates into the cell with difficulty; the window is barred with 4 rows of metal bars. In the window recess is present dust and poplar fluff, which easily penetrates the cell, measures for vacuuming these wastes are not taken.
also, sanitary and hygienic conditions in the cell 46 does not correspond to Art. 225of Execution Code, which states that the cells for the accommodation of detainees shall correspond to hygiene and health standards stipulated in construction requirements of the Republic of Moldova, including volume, space, lighting, heating and ventilation:
a. Thus to that the cell walls were whitewashed, the floors are cold, made by beton, the fact of the mentioned cell location in the basement constitute a risk of infection with tuberculosis;
b. A significant deficiency constituie that the valve, which provides drinking water in the cell is located immediately above the toilet, the water drained from it being discharged directly into the toilet and serves to discharge wastewater. So from this tap inmates take drinking water, maintain personal hygiene and wash their dishes;
c.Inmates are not provided with mattresses, bedding;
The convict who is held in cell No. 46, mentions that he was detained this cell previously, which actually, by a decision of the Central District Court (case no. 2-4109/13) was established that his detention in the cell no.46 of the Penitentiary nr.13 from Chisinau is a violation of fundamental rights provided by art. 24 of the Constitution of the Republic of Moldova and art. 3 ECHR.
As a result of repeated detention of the prisoner in the same cell with the same conditions holding which was considered as a violation of fundamental rights, in address of of the Department of the Penitentiari Institutions was presented a recomendation to close the cell nr. 46,until its redevelopment in existing standards related to ensuring the conditions of detention, especially the sanitary fittings, a sink for drinking water and maintaining only two beds instead of two double beds.
