The Parliamentary Advocate of Republic of Moldova Aurelia Grigoriu and the Ukrainian Parliament Commissioner for Human Rights Valeriya Lutkovska monitored the observance of human rights at Republic of Moldova-Ukraine border customs crossing points.

On 17 May 2013, Parliamentary Advocate Aurelia Grigoriu with the Ukrainian Parliament Commissioner for Human Rights Valeriya Lutkovska  identified during the inspection visit existing problems at compartment of human rights observance on crossing the state border points Maiaki-Udobnoe-Palanca,  Starokazacie – Tudora and  will present to Moldovan and respectively, Ukrainian leadership its recommendations for their elimination.

According to the statements of both ombudsmen were established several objective reasons which causes queues forming at the entrance of Moldovan citizens crossing the Ukrainian customs posts. There are significant differences related to technical ensuring with equipment of customs and border services (border police) providing the necessary staff to Moldovan and Ukrainian side. National legislation in the field of both countries foresees a degree of attributions which offers a framework more or less extensive of concerned services mobility. As a result, at the Moldovan customs posts can be assured a continuous flow of people, bottlenecks appears at the narrow roads leading to Ukrainian customs border points.Traffic jams forms, usually in peak periods such as the July-August. In this period of time Ukrainian border crossing points in this area are overburdened by Moldovan citizens that are going to summer holiday on the Black Sea.

Another issue was addressed in the context to ensure decent conditions as required international standards in the field of surrounding areas, Ukrainian customs border crossing points such as public access to potable water and sanitary facilities, setting up shelters and waiting areas, installation of car parking areas.

Aurelia Grigoriu and Valeriya Lutkovska saluted the decision of European Union to implement a project to open a joint Moldovan-Ukrainian border crossing point Palanca-Maiaki, That in most part will solve the problems in this part of the border crossing. The concerned project is estimated at 5 million EURO and is planned to be carried out during 3 years.

Until then, the district administration of Odessa and Belgorod Dnestrovsk regions at the Ukrainian Ombudsman's recommendation will soon take landscaping action to adjust the adjoining territory of access road to the Ukrainian board crossing points. In perspective, shall be solved the problems  regarding the extension and proper arrangement of the section of road between customs border crossing points Starokazacie-Tudora, that are managed by the Ukrainian side.

The Parliamentary Advocate Aurelia Grigoriu with the Ukrainian Parliament Commissioner for Human Rights Valeriya Lutkovska stressed the importance of performed monitoring which fits into the existing cooperation between ombudsman offices of both countries. Also, ombudsmen pleaded for increasing of cooperation between customs services, border police, foreign ministries of Ukraine and Republic of Moldova into solve the existing problems and to ensure the respect for human rights at the Moldovan-Ukrainian border crossing points.

The inspection of crossing points Maiaki – Palanca, Udobnoe, Starokazacie - Tudora was conducted in response to summer’s 2012 complaints of Republic of Moldova citizens. Then many petitioners complained to the Centre of Human Rights about endless queues and congestion at the customs crossing point Starokazacie - Tudora. According to information, tens and hundreds of Moldovan citizens were kept in the sun for hours without access to potable water and sanitary facilities.

The Parliamentary Advocate appreciated then as degrading and violates the dignity of Moldovan citizens nominated conditions at the concerned border crossing point, asking Ukrainian Parliament Commissioner for Human Rightsto intervene into redress the situation. The Ukrainian Ombudsman made the necessary demarches to unlock the traffic. Later Valeriya Lutkovska  and Aurelia Grigoriu agreed to conduct a joint visit in 2013 at border crossing points on the southern segment of the Republic of Moldova -Ukraine border.

During the inspection visit ombudsmen were accompanied by human rights experts, representatives of the Moldovan border police and Border Guard Service of Ukraine, the customs services of two countries, local public authorities of the region representatives of the Republic of Moldova Embassy to Ukraine.
