As a result of Ombudsman's intervention, a person-victim of domestic violence obtained the protective order and against the abuser was filed a criminal case on the fact of applying violence in the family.
On 11th July, to the People`s Advocate Institution addressed N.Ţ. from Teleneşti district. The petitioner complained that her ex-husband, S.E., which, according to the woman, comes to her home and abuses her psychologically by actions manifested trough insults and threats that occur in the presence of children. The petitioner argues that this is happening despite the fact that S.E. was previously sanctioned for committed abuses.
From the information presented by the petitioner, follows that her ex-husband had previously been held to contravention accountable for insults and mild hooliganism. For this he got a fine.
In order to elucidate the circumstances and intervention of where necessary for taking measures to protect the victim and its children, the Ombudsman has addressed to Police Inspectorate of Teleneşti district.
Following the Ombudsman's intervention, the Police Inspectorate Teleneşti remitted to the court a request for issue of protection order towards the victim, which was obtained by the conclusion of Teleneşti court. In case of violence applied by S.E. to his ex-wife was running a criminal trial, a decision in this regard should be undertaken in accordance with Article 274 of the Criminal Procedure Code.
Domestic violence is an ongoing problem both at the national and European levels. In order to regulate some various aspects related to combat of this negative phenomenon, in 2007 was passed the Law on prevention and combat of domestic violence. A first binding regional instrument in Europe that comprehensively addresses various forms of domestic violence is the Istanbul Convention, adopted by the Council of Europe in 2011. Till present the Republic of Moldova has not neither signed nor ratified the Council of Europe Convention on prevention and combat of violence against women and domestic violence.
Last year the ECHR sentenced Moldova in a case of violence: in case Eremia and others v. Moldova the European Court found a violation of Articles 8 and 14 of the Convention in conjunction with Article 3. In the Court's decision is stated that the failure of the state to solve the issue of violence has led to repeat of it, which was reflected in a discriminatory attitude of the victim as a woman.
