Training for the representatives of the carabineers troupes.

On 21 March 2014 at the military unit of the carabineers troupes took place a seminar “International and national standards that ensure the right not to be subjected to torture or cruel treatment, inhuman or degrading treatment. Cases and limits of physical force, special means and firearms application. ”

The event was held within the realization of CHRM’s Service of Monitorization and Investigation Plan and the tasks set out in section 6.4.3. of the Action Plan for implementation of the Justice Sector Reform Strategy for the years 2011-2016; Strategy for reforming the justice sector for the years 2011-2016 (approved by Parliament Decision no. 6 din16.02.2012), which establishes the need to instruct in the field of prevention and combat of torture and ill-treatment the employees of those institutions that provide retention and detention of persons.

The event was attended by 50 warrant officers from the military unit. During the seminar Mr. Gheorghe Bosîi the principal consultant of the Center for Human Rights of Moldova tackled the following topics: national legislation regulating crime of torture and accountability for acts of maltreatment, as well as form of torture and the activity of the National Mechanism for the Torture Prevention. Mr. Iurie Dubenco addressed the following topics: the jurisprudence of the European Court of Human Rights in relation to the art. 3 ECHR – ban of torture,limits of physical force, special means and firearms application.

The CHRM employees Iurie Dubenco și Gheorghe Bosîi informed the participants about the history of the National Mechanism for the Torture Prevention, its rolein the prevention of ill-treatment of persons under custody of the state. However, in the context of numerous convictions at the European Court of our state for violation of Art. 3 ECHR (prohibition of torture) the representatives of the carabineers troupes were informed about the need to respect in the activity provided by them, the legal and ethical norms.

The key elements in bridging of risk situations are legality and professional attitude of the law enforcement authorities personnel, respecting the dignity and the physical and psychological integrity of all persons.

Also the officers were informed about the provisions of human rights observance in the Republic of Moldova as well as the Association Agreement with the European Union. In this respect the officers were intentioned on the priority to be given in promotion of rule of law, effective function of institutions in the field of human rights protection.
