Within the activity of the National Mechanism for Torture Prevention, the employee of the Center for Human Rights from Moldova, Gheorghe Bosîi, made a preventive visit to Penitentiary Institution Nr.13, to check the V. D. citizen conditions of detention, arrested for not having bought health insurance mandatory policy: He did not executed ​​the decision of contravention fine application, a reason from which the penalty was replaced by contravention arrest for a period of 25 days.

The CHRM representative found several irregularities in cell no. 21 of Detention block. Nr. 2 in Penitentiary Nr. 13, where, along with another 15 people, was detained V.D. It has been determined that the cell is overpopulated. Or, according to national and international standards the minimum space that shall be provided to a person in detention is 4 m². The beds were placed next to each other; ventilation is done only naturally (by window and door opening).

Regarding the conditions of detention in cell nr. 21 were also found that natural light is available, but sanitary and hygienic conditions do not correspond to Art. 225 of the Execution Code. The toilet, though it is isolated from the rest of the cell, is in poor condition and needs repair, as well as the washbasin in the toilet block. It was also established that the Penitentiary nr.13 is not designed with separate areas for people punished by contravention arrest. So D.V. is detained with persons that are in preventive arrest, the prosecution or those whose cases are examined in court

On the basis of the findings during preventive visit and in order to improve the situation of detainees and guarantee compliance of constitutional right to physical and mental security guaranteed by art. 24 of the Republic of Moldova Constitution, to the Minister of Justice were issued an opinion in regard to the improvement of detention conditions for persons serving sentences of imprisonment for committed contraventions:

1.    To dispose the planning of separate sector in Penitentiary nr 13 for persons punished by contravention arrest.

2.    To realize urgent action for not allowing the overcrowding of cell nr. 21, as well as other cells of the Penitentiary nr. 13.

3.    To undertake measures for ensuring sanitary and hygienic conditions in sanitary block of the cell nr. 21, with its capital repair.
