The CHRM representative – at the International Conference”25th anniversary, the European Committee for the Prevention of Torture and Inhuman and Degrading Treatment or Punishment: taking stock and moving forward”

The International Conference the European Committee for the Prevention of Torture and Inhuman and Degrading Treatment or Punishment: taking stock and moving forward” took place on 02 March 2015 in Strasbourg in the Palais de l’Europe, and bring together experts and officials from the 47 Council of Europe member-states. The CHRM’s principal specialist Gherghe Bosîi participated on tematic panel „Combating impunity in police and prison and prison context”

In the speeches of CPT members and participants to the Conference was stressed the need to combat ill treatment, and an important role here comes to preventive mechanisms both to CPT as European mechanism  as well as national mechanisms for prevention of torture in the member-states .

During the Conference was noted the role of police in society – first structureaimed to protect the fundamental rights of the people. Was also discussed about the importance of combating impunity and protecting human rights by policemen, through observance of legal norms and continuous education on human rights standards. In this regard it is essential to ensure guarantees immediately after the arrest - the right to a lawyer and presentation of detained person's rights, the right to inform relatives about the detention and the right to be examined by a doctor.

With regard to penitentiaries activity was stressed that these institutions are created primarily for the rehabilitation of convicted persons, criminal punishment having no purpose of causing physical or mental suffering.

From the perspective of national mechanisms for torture prevention activities, was mentioned their task to monitor the detention institutions, the role for prophylaxis of ill-treatment and notification of the prosecutors in the case of psychological or physical abuse detection. Consequently, if there was a case of torture, the fact finding mission lies with prosecutors. Structural changes in the police and penitentiaries activity, including in the direction of avoiding of ill-treatment application must be waited patiently, material efforts being needed and mentality change.

For the Republic of Moldova were quite important those 12 visits made by CPT. However, much of the findings made by CPT have been used in decisions of the ECHR, and provided recommendations formed the basis of amendments in national legislation and structural changes designed to combat ill-treatment or to improve the conditions of people that are in state custody.
