The activity of National Mechanism for the Prevention of Torture in September 2013

In accordance with the mandate of the National Mechanism for the Prevention of Torture in September were made 15 visits to the isolators for preventive detention and penitentiary institutions.

The employees of the CHRM Cahul Representative office made 4 preventive visits to the territorial police inspectorates( 13.09.2013 – IP Cantemir; 17.09.2013 – IP Cahul; 19.09.2013 – IP Taraclia and Vulcănești) and one,  on 19 September to the Penitentiary Institutionnr. 1 from Taraclia.

4 preventive visits were made by the staff of the CHRM Bălți Representative Officeto the territorial police inspectoratesin Briceni and Edineț on 05.09.2013 as well on 26.09.2013 to the Rîșcani and Edineț police inspectorates.

The staff members of CHRM Comrat Representative Office made 5 preventive visitsto the police inspectoratesin Comrat, Ceadîr Lunga, Basarabeasca, Leova, Cimișlia with one visit toPenitentiary Institution nr. 3 from Leova.

Those visits were aimed at preventing ill treatment application to persons that are in custody of detention authorities. It was established the existence of tendency for legal provisions observance related to ensuring the guarantees against ill-treatment. So the detained persons are guaranteed with the right to inform their close relatives about the apprehension, to be examined by a doctor and the right to defense.

In the majority of the preventive isolators within police inspectorates the detention conditions meet the rigors provided by the national and international standards.

It was established that as a result of CHRM recommendations at the Taraclia Penitentiary Institution was started the reconstruction of the canteen and kitchen. This shall enable prisoners to dine in decent conditions and the quality of preparation and storage of the products will meet certain health standards.

Also during September were carried out some instructive activities on the combat of torture and ill-treatment prevention topics.

Provisions of national law,torture well as other categories of offenses, Republic of Moldova's commitments for the eradication of torture, administrative measures,   legislative and judicial were the topics that were addressed by the principal consultant of the Center for Human Rights of Moldova, Gheorghe Bosîi at the Seminar "Evaluation of minimum conditions according to international standards and European minimum Standards of detention to ensure the observance of the right not to be subjected to torture or cruel and, inhuman punishments or degrading ill-treatment" that took place on September 10 in Soroca.

The training took place under the MATRA project, implemented by the Institute for Human Rights from Moldova. The seminar was attended by 19 representatives of the Police Inspectorates of northern districts of the country – Heads of operational management sections and 4 representatives of the Operational Management Division within the General Police Inspectorate.

In September also appeared printed materials of the international scientific-practical conference "5 years from the creation of NPM in the Republic of Moldova".

Torture and inhuman or degrading treatment or punishment are prohibited and constitute serious violations of human rights. So the article 24 of the Republic of Moldova Constitution and article 3 of the European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR) prohibits in absolute terms the application of torture and inhuman or degrading treatment.

The effective prevention of torture and inhuman or degrading treatment or punishment requires education and a combination of various legislative measures, administrative, judicial or of other nature and efforts for torture eradication should first focus on prevention based on a preventive system of regular visits to places of detention.
