The Parliamentary advocate Tudor Lazăr sues in instance the discriminatory law adopted by the People's Assembly of ATU of Gagauzia (Gagauz Yeri)

On 30.04.2013, the People's Assembly of ATU Gagauzia (Gagauz Yeri)adopted the Law on Ensuring the principles of equality, equity and objectivity, which was subsequently promulgated by the Governor of ATU Gagauzia, (Gagauz Yeri), Mihail Formuzal and entered into force on the same day once published in the Official Bulletin of Gagauzia "Expres-Kanon". The concerned law is one that excludes any protection for sexual minorities in this region, with the argument to keep cultural traditions and customs of the Gagauz community.

Analyzing the mentioned law through the principles of law, human rights and fundamental freedomsthe Parliamentary Advocate Tudor Lazar believes the provisions of Article 7 alin. (7), Article 10 and Article 11 alin. (2) and alin (5) of the Law in question as some that exceed allowed constitutional limits. In the Ombudsman's opinion, the concerned norms contradict to the provisions of Articles 16 and 54 from Constitution of Republic of Moldova, to the Law on ensuring equality of Republic of Moldova No. 121 from 25.05.2012, the provisions of Articles 2 and 12 of the Law on the Special Legal Status of Gagauzia no. 344 of 23.12.94, as well as the provisions of international acts on the protection of human rights on which our country is a party.

In this context, on 27.05.2013, the Parliamentary advocate Tudor Lazăr submitted to the administrative contentious instance of town Comrat a request for annulment of Article 7 alin. (7), Art 10 and Art 11 alin. (2) and (5) of the Law on ensuring the principles of equality, equity and objectivity Nr. 89-X/V from 30.04.2013. However, the Ombudsman requested that until the substantive examination of the case, the action concerned norms to be suspended.
