The CHRM Director Anatolie Munteanu urges the Ministry of Health to renounce from a formal practice in approaching of Ombudsman’s recommendations.
The citizen M.P. invoked at the National ombudsman institution that, appealing to the Forensic Center, he was treated by forensic doctorsuperficially. The petitioner also wasn’t agree with the results of the expertise.
In the examination of the mentioned petition the parliamentary advocate requested from the Minister of Health to verify the circumstances cited by the petitioner M.P. and taking the necessary measures, as appropriate, with CHRM information in the established terms according to the law.
In the notice submitted the Minister of Health the Parliamentary advocate stressed that medical staff in their professional activity must strictly respect the deontological rules, treat with respect, responsibility and competence the patients. The Ombudsman also revealed it is the duty of the Forensic Centre employees to act with the highest care, taking into account that the judicial expertise and forensic findings have great probative value in a trial.
Given that on the first notice with recommendation was received a formal reply, signed by a head of department in the Ministry of Health, the parliamentary advocate sent repeatedly a demarche with the same content. But even this time, the response was evasive. That even if in this case it was signed by the Deputy Minister of Health, Mihail Ciocanu.
According to art. 24 (4) of the Law on Parliamentary Advocate, the Ombudsman makes use of the opportunity to inform and raise public awareness on inappropriate way of addressing the Parliamentary advocate's recommendations by officials from the Ministry of Health. The CHRM Director mention that, while in other cases there was effective collaboration between the institution of Parliamentary advocate and the Ministry of Health, in carrying out recommendations concerning citizen M.P. petition, the officials from the Ministry of Health have shown some refractory attitude.
Mr. Anatolie Munteanu, calls the Ministry of Health to waive the formal approach practice of Ombudsman’s recommendations, expressing hope in restoring of good cooperative relations with the responsible officials of the health system in the interest and benefit of the citizens.
