Instructive Seminar for the employees of the penitentiary system

On 19 March 2014 in Training Center of the Department of Penitentiary Institutions from Goian took place a seminar "Guarantees Against Torture (relations between employees and inmates), international and national standards that ensure that the right not to be subjected of torture, cruel punishment, inhuman or degrading treatment. "
The event was held within the realization of CHRM’s Service of Monitorization and Investigation Plan and the tasks set out in section 6.4.3. of the Action Plan for implementation of the Justice Sector Reform Strategy for the years 2011-2016; Strategy for reforming the justice sector for the years 2011-2016 (approved by Parliament Decision no. 6 din16.02.2012), which establishes the need to instruct in the field of prevention and combat of torture and ill-treatment the employees of those institutions that provide detention of persons.
The event was attended by 39 warrant officers from security service, escort and supervision of DPI - Employees who pass the initial training courses to employment in the service of the penitentiary system. During the seminar Mr Gheorghe. Bosîi the principal consultant of the Center for Human Rights of Moldova addressed the following topics: national legislation regulating crime of torture and accountability for acts of maltreatment.The jurisprudence of the European Court of Human Rights in relation to the art. 3 ECHR - torture, the activity of the National Mechanism for the Prevention of Torture. Republic of Moldova's commitments, the role of the mechanism as extrajudicial extent of protection of the right to physical and mental integrity of persons; practical aspects of the consequences of maltreatment.
The consultant Gh. Bosîi informed the participants about the history of the National Mechanism for the Torture prevention, its rolein the prevention of ill-treatment of persons under custody of the state.
However, in the context of numerous convictions at the European Court of our state for violation of Art. 3 ECHR (prohibition of torture) the new prison system employees were informed about the need to respect in the activity provided by them, the legal, ethical norms, rights of persons deprived of their liberty so as to achieve the goals of criminal punishment - isolation of dangerous persons from the society and their correction.
Participants in the seminar discussed issues arising in practice in difficult situations when inmates violates the rules of behavior or seriously disturbs the order in prison, highlighting cases where physical force can be used or special means and how to document such cases. Key elements in bridging these situations are legality and professional personnel of the penitentiary system, respecting the dignity and the physical and psychological integrity of detainees.
