Participants in the liquidation of consequences of the Chernobyl accident were reinstated in their rights after the intervention of the Parliamentary advocate Aurelia Grigoriu.
Spouses G., participants in liquidation of consequences of the Chernobyl accident were reinstated in their rights after the intervention of the Parliamentary advocate, Aurelia Grigoriu, the Ministry of Health of the Republic of Moldova.
Spouses G. habitants of village Dezghinja, Comrat Region made an address to the Center of Human Rights from Moldova and pleaded on infringement of the right to free access to justice, in the aspect of non execution of judicial decision and respectively the right to social assistance and protection. Given that the competent authorities have not recognized the validity of identification document of participant to liquidation of consequences of Chernobyl accident issued by the authorities of Ukraine, petitioners made a request to establish this fact by competent court. Thus to that, thru judicial decision from December 28, 2009 the fact of participation of Spouses G in liquidation of consequences of Chernobyl catastrophe was confirmed and ordered to Council on medical expertise of vitality Comrat to carry out medical vitality examination of mentioned persons in order to establish a causal link to disability related to Chernobyl case.
The Parliamentary advocate considers to be unjustified actions / inactions of the judicial executors as well as the establishment authorities to the vitality expertise that delayed the execution of the judicial decision, which is mandatory for all public authorities used all legal measures to solve petitioners problem. Thus, the Parliamentary advocate has repeatedly notified Department of Execution, Chairman of the Comrat medical expertise on vitality as well as the Chairman of Republican Council of vitality medical expertise with recommendation to strength the efforts on reinstatement in rights of mentioned petitioners, which efforts have proved not to be effective. Finally, under the initiative of the Parliamentary advocate regarding this issue were organized a meeting with the Minister of Health Mr.Vladimir Hotineanu where was decided to verify the documents for supposes G. by the Interdepartmental experts Council of the Ministry of Health in order to establish a causal link to disability related to Chernobyl case. Later the CHRM was informed on the presentation of mentioned documents and the establishment of a causal connection of diseases and disability of supposes G with their participation in the liquidation of consequences of the Chernobyl accident.
The parliamentary advocate appreciates the efforts of the Minister of Health in the solving process of this case, reiterating that an objective approach to the area of human rights is possible only in a result of effective cooperation with public authorities, state institutions and NGOs.
