Ombudsman calls for and gets guaranteed by state legal assistance for a group of petitioners
The Centre for Human Rights of Moldova registered a collective application of 43 petitioners from a village Şoldăneşti. In their appeal the petitioners invoked the violation of the constitutional right to defense provided for by Article 26 of the Republic of Moldova Constitution.
In 2007 the petitioners concluded lease agreements on shares land planted with orchard owned by them in common with the village farm for a period of three years. According to the contracts the mentioned Farm assume the obligation to pay the annual lease payment in the amount of 250 lei per share land area of 0.08 ha.In spring of 2009 the mentioned Farm announced the petitioners about the cancellation of contracts and bankruptcy.
Without receiving lease payment in 2008, although the tenant used the land and harvesting the fruits, the petitioners have filed a notification of the proceedings to the Peasant Farm on receipt of lease payment then asking for payment of material damage. By Şoldăneşti Court decision the application was fully admitted. But this decision was challenged by respondent in Balţi Appeal Court.
On examination of mentioned notice, Tamara Plămădeală the Parliamentary Advocate for the protection of children’s rights made a request to Balti Territorial Office of the National Council of State Legal Assistance. In a result, the petitioners received a lawyer that was appointed for necessary legal services.
